Food legislation and the protection of allergic and hypersensitive persons: an overview.

So far there are worldwide no legal instruments in protecting people against adverse allergic reactions to the consumption of foods. Instruments, which generally were developed for health protection in food legislation, are not suitable to regulate the protection of allergic persons because they automatically would exclude all protein-containing foods from commercial market. The only approach to an effective protection is to indicate the presence of adverse effect causing agents or ingredients on the label. This preventive instrument was developed by the Codex Alimentarius and led to an open "hit list" of ten Major Serious Allergens, which have to be labeled. The hit list principle was adopted by the EU-Commission as a draft for an EC-Directive. Unsolved problems are exeptions from the labeling requirement for refined oils and a minimum limit of adverse effect causing agents which do not require labeling.

[The food legislation evaluation of environmental chemicals in freshwater fish].

During the last 1 1/2 decades different regulatory limits have been given to value pollutants in fish under food-legal aspects. Their requested target, which consists of an effective consumer's protection however has been missed by various reasons: The production and distribution of environmental pollutants cannot be suppressed by limits for food. The selective elimination of limit-exceeding individuals from a lot is impossible. Treating both, natural pollutants like geogenic mercury and anthropogenic ones similar seems to be indefensible with regard to food law. Therefore proposals are made to rule only anthropogenic pollutants by law, when regulatory limits are planned to be supplemented. In case of natural distribution less stringent advisory limits seem to be more suitable.

[Incorporation of the Hazard Analysis and Critical Control Point system (HACCP) in food legislation].

The Hazard Analysis and Critical Control Point system (HACCP), recommended by different international organizations as the Codex Alimentarius Commission, the World Trade Organization (WTO), the International Office of Epizootics (OIE) and the International Convention for Vegetables Protection (ICPV) amongst others, contributes to ensuring the innocuity of food along the agro-alimentary chain and requires of Good Manufacturing Practices (GMP) for its implementation, GMP's which are legislated in most countries. Since 1997, Colombia has set rules and legislation for application of HACCP system in agreement with international standards. This paper discusses the potential and difficulties of the legislation enforcement and suggests some policy implications towards food safety.

A selective survey of national legislation on foods for infants and young children.

Food legislation and food control infrastructures play a substantial part in determining the quality and quantity of the diet. However, in many countries they are not sufficiently developed in enable adequate protection. As an aid in formulating and improving legislation on foods for infants and small children, a study of existing laws was undertaken for FAO's Legislation Branch, Legal Department. The following is a synopsis of the main findings, supported by a review of international codes.
