Marriage and fertility in China: 1950-1989.

"This article presents a graphical and a life table analysis that summarizes some 14,000 values of data by single year of age and time on marriage and fertility in China up to 1989. In the 1970s, age at first marriage shifted upward by about four years, and fertility dramatically declined. The age at marriage and childbearing decreased in [the] 1980s, which are associated with some socio-economic factors. Fertility rates slightly increased in the second half of the 1980s, from their low level in 1984. The analysis also reveals that Chinese marriage and childbearing remain virtually universal and occurred at rather young ages." Data are from the 1988 2-in-1,000 fertility and contraceptive survey. [[Trends in demand and supply factors of marriage in the Japanese never-married population: findings from the Tenth Japanese National Fertility Survey]].

"The purpose of the present paper is to describe findings from a survey on attitudes toward marriage and family among Japanese never-married youth from the point of view of the general framework of the demand and supply system. The survey was conducted as a part of the Tenth Japanese National Fertility Survey on the first of July in 1992.... The results...indicate that never-married people in Japan are in a kind of paradoxical situation in which they complain about such difficulties...as insufficient availability of prospective spouses, while they have weaker motivation to get married.... This situation can possibly be explained by [the] increasing level of expectation for marriage and spouse due to dynamic changes in [the perceived] function of marriage." (SUMMARY IN ENG)

F. v. Switzerland, 18 December 1987.

The applicant challenged a three-year ban on remarriage placed on him by a Swiss court pursuant to Article 150 of the Swiss Civil Code following his third divorce. The Court held that the three-year ban was in violation of Article 12 of the European Convention on Human Rights, which protects the right to marry. While it recognized that the ban served a legitimate purpose of protecting marital stability, it ruled that the means chosen by the Swiss Government were disproportionate to the aim pursued.

Law No. 90 of 1987, 5 September 1987.

This Law amends Article 8 of the Law of Personal Status (No. 188 of 1959) to authorize a judge to permit the marriage of persons aged fifteen to eighteen "if he finds an ultimate necessity for that." In usual circumstances, the capacity to contract marriage is attained on reaching eighteen years of age.

The dissolution of Muslim Marriages (Amendment) Ordinance, 1986 (No. 25 of 1986), 30 March 1986.

This Ordinance amends the Dissolution of Muslim Marriages Act, 1939, to permit as a ground for dissolution of a Muslim marriage by the wife the fact that "she, having been given in marriage by her father or other guardian before she attained the age of eighteen years, repudiated the marriage before attaining the age of nineteen years." Previously the ages were set at sixteen and eighteen years, respectively.

Subanu alias Saira Banu v. A.M. Abdul Gafoor, 3 April 1987.

The appellant, a Muslim wife, sought maintenance for herself to live separately from her husband because he had taken a second wife. In overturning a lower court ruling, the Supreme Court held that the appellant was entitled to maintenance. It relied on Section 125(3) of the Criminal Procedure Code, which it construed as conferring the right upon a wife to refuse to live with her husband if he has contracted another marriage and to obtain maintenance. It concluded that this right was not negated by the fact that Muslim personal law permits a husband to have more than one wife.

[The changing family contexts of children in the United States].

"This paper reviews the roles of divorce, nonmarital childbearing, and cohabitation in the changing family contexts of children, and then provides new estimates of current family composition which incorporate cohabitation. The underlying process is viewed in terms of the declining significance of marriage linked to long-term trends in individuation. Half of all children in the U.S. will spend some time in a single-parent family, and nonmarital childbearing is an important factor creating these families. At the same time, increased cohabitation requires that family definitions which are based on marital status in the U.S. be replaced with those that include cohabitation. A sixth of traditionally defined ¿mother-only' families are cohabiting two-parent families, and the one-fourth of current stepfamilies that are cohabiting are missed by marriage-based definitions."
