The malpractice controversy and the quality of patient care.
The widespread doctor strikes of 1975 stimulated belated attention to a crisis in malpractice insurance. Most state legislatures responded only to a shadow crisis in insurance as they rallied to the defense of health care providers. The smouldering substantive crisis--the reality of malpractice--is now galvanizing institutions and professions into aggressive activities for quality assurance and renewal of trust between patient and doctor. New procedural experiments offer prospects for preserving economy and equity by containing the causes of malpractice suits within the health care system itself.

Gaucher disease, enzyme replacement therapy, and the Patient Assistance Program.
Gaucher disease is the most common lysosomal storage disorder characterized by a missing enzyme, glucocerebrosidase. Enzyme replacement therapy has been available in the form of Ceredase (Genzyme Corporation, Cambridge, Massachusetts) (alglucerase injection) since 1991, and in the form Cerezyme (Genzyme Corporation, Cambridge, Massachusetts) (imiglucerase for injection) since 1994. Because of the high cost associated with enzyme replacement therapy, the Genzyme Corporation, manufacturers of Ceredase and Cerezyme, developed the Patient Assistance Program. The program assisted those patients who chose to use it with the facilitation of coverage approvals from their insurance carriers. The program has become a comprehensive case management service made up of nurses and social workers who work with patients on many issues from access to coverage. Case managers also provide support to providers who are transitioning patients to home therapy. Home health agencies can benefit from the information and assistance offered by this program as well as other resources throughout Genzyme and the Gaucher community.

Tort reform, round 2. TMA lobbyists examining likely medical liability issues for 1997.
Texas physicians won one of their biggest victories ever in the battle over tort reform in 1995. At the urging of the Texas Medical Association and other groups, lawmakers enacted legislation requiring plaintiffs in medical liability cases to post cost bonds and expert reports showing their cases have merit. Rules for expert witnesses were tightened. And, physicians and other defendants were given some relief from joint and several liability, which often leaves defendants who were only marginally at fault facing multimillion-dollar judgments because they have "deep pockets."

Statute of limitations. Key to understanding dental malpractice cases.
Many dentists ask about the process followed in a dental malpractice case. Often, the actions of the insurance carrier handling the matter mystify the dentist who is the defendant. What follows is the first of a series of articles outlining what happens in a typical malpractice case. It concerns the malpractice statute of limitations, a vital component to understanding the process of commencing a dental malpractice case.
Insurance underwriting in the genetic era.
Genetic technology is assuming a greater role in the practice of medicine. Insurers have a vested interest because individually underwritten insurance cannot be sold without risk classification, and much of the medical information needed to classify risks will have a genetic component. This paper reviews recent genetic advances and their potential impact on life, disability income, long-term care, and critical illness insurance. Alzheimer disease is chosen to illustrate the effect of an organized effort to withhold medical information from insurance companies. Consumers will not support a private insurance mechanism with extensive cross-subsidization among policyholders and where medical information becomes inviolate simply because it is genetic. A framework for deliberations with the medical community is proposed.
