Regional Law No. 1, 20 January 1988.

This Law is designed to protect the physical and mental health of women and the unborn in Basilicata, Italy. It provides for activities related to information, birth preparation courses, means of organization and assistance that favor childbirth with respect to the mental needs of the woman giving birth and the unborn child, and rules for the protection of hospitalized newborn children.

Decree of the National Institute of Perinatology, 14 July 1988.

This Decree sets forth the organization and functioning of Mexico's National Institute of Perinatology. The objectives of the Institute are the following: 1) to support the functioning and consolidation of the National Health System and to contribute to the fulfillment of the right to health protection with respect to perinatal care; 2) to support the execution of sectoral health programs within the scope of the System's functions and services; 3) to provide health services to women experiencing high risk pregnancies, in particular, services related to preventive and curative medicine and surgical procedures; 4) to provide medical consultation and hospital assistance, as well as services for human reproduction, growth, and development, in the installations created for this purpose; these services will either be free of charge or the charge will be based on the social and economic conditions of the users; 5) to provide measures of social assistance for those patients who lack economic resources; 6) to conduct studies and clinical research in the biomedical field and related sciences for the prevention, diagnosis, and treatment of perinatal diseases and in compliance with the provisions of the General Health Law and applicable regulations; 7) to provide technical and scientific information on health findings and improvements as well as to publish the outcome of studies and work undertaken; 8) to promote and hold meetings and carry out scientific national or international exchange programs with similar institutions; 9) to advise and deliver opinions to the Health Secretary when requested; 10) to function as an advisory committee for the relevant institutions of the Federal Public Administration and social and private institutions in this field; 11) to exploit specialized human resources for attention to perinatal problems in compliance with the applicable regulations; 12) to organize and implement educational and professional programs in the field of perinatal care for the professional, technical, and auxiliary staff; 13) to confer academic awards and give recognition to studies in compliance with applicable regulations; 14) to promote the execution of health protection activities according to the applicable regulations; 15) to provide all other services and necessary activities to fulfill the goals of this Decree and other applicable regulations. Further provisions of the Decree deal with the duties of the Governing Board and the Director General, among other things.

Ministerial Resolution No. 392-88-SA/DM, 24 October 1988.

This Resolution sets forth the Regulations on the organization and functions of the Peruvian National Maternal-Child Institute, created by Supreme Decree No. 022-87-SA. The following are among the functions of the Institute: 1) to propose a policy of maternal-perinatal care; 2) to encourage and realize basic, clinical, and operative research, developing technologies appropriate to the national maternal-perinatal health situation; 3) to disseminate to all levels scientific results in the maternal-perinatal area; 4) to coordinate and develop specialized training programs in maternal-perinatal health directed at health personnel and the community; 5) to contribute to the improvement and training of all personnel participating in activities aimed at gynecological, obstetrical, and perinatal care; 6) to intensify the training of specialists required for the care of women and childbirth; 7) to facilitate the decentralization of maternal-child care in order to achieve specialized care; 8) to propose rules and procedures for maternal-perinatal care; 9) to advise the High Directorate of the Ministry of Health with respect to maternal-child care; 10) to coordinate, support, and evaluate activities carried out by public and other institutions directed at maternal-perinatal health care; and 11) to increase and improve the quality of institutional care services for women of child-bearing age, pregnant women, child-birth, and the recently born, with the priority of developing care of greater sophistication. Further provisions of the Resolution set forth the organization, interinstitutional relations, and resources of the Institute, among other things.

Decree No. 013/PRG concerning creation of a National Guinean Commission of Literacy and Adult Education, 21 January 1987.

This Decree creates a National Guinean Commission of Literacy and Adult Education under the Minister of National Education. The following are among the goals of the Commission: 1) to regroup the organizations, both public and private, that are engaged in adult education and literacy, with the goal of making their activities more useful; 2) to formulate adult education programs and strategies to combat illiteracy, keeping in mind the policy of human advancement; 3) to harmonize and coordinate all literacy programs and adult education activities; 4) to further the development and implementation of programs relating to literacy, adult education, and continuing and professional education; 5) to undertake studies and research relating to literacy, national languages, and adult education; and 6) to collect and disseminate information, documents, and studies in the area of literacy and adult education in Guinea and elsewhere. Further provisions of the Decree deal with the composition, organization, and resources of the Commission, among other things.

Order No. 60/MEN/FP/ALPHA relating to the creation of a national committee to eliminate illiteracy in the Niger, 3 May 1988.

This Order creates a National Committee to Eliminate Illiteracy in the Niger consisting of members appointed by the Minister of National Education and Professional Training. The objectives of the Committee are: 1) to lend its support to national education structures in pursuing the battle against illiteracy; 2) to collaborate in the definition of a national policy with respect to literacy and adult education; and 3) to formulate and execute a program making the public aware and giving them information about the problem of illiteracy and its impact on the development of the Niger.

Amendment of the Ordinance on Civil Status, 28 November 1988.

This Amendment inserts into the Swiss Ordinance on Civil Status of 1 June 1953 provisions relating to the electronic management of data. It provides that the authorization of such systems of management is left to cantonal authorities and that the cantonal authorities are to furnish information about such systems to the Federal Office of Civil Status. It also provides rules on limited access to data, reports based on data, and forms, among other things. In addition, the Amendment makes a number of small changes in the Ordinance relating to names, security of data, publication, foreign domicile, and the application of national law, among other things.

Order on the guidance file provided for in Article L. 162-3 of the Public Health Code, 29 December 1987.

Guidance files (dossiers-guides) are intended for physicians practicing in the department; in public and private hospital establishments; in family planning and family education centers; in establishments providing family information, advice, or education; in social services; and in other agencies approved by French departmental authorities responsible for health and welfare matters. The Annex sets out, on the one hand, conditions for voluntary termination of pregnancy (the legislation on voluntary termination of pregnancy, procedures to be followed, medical data, consultations following voluntary termination of pregnancy and contraception, and the costs of termination of pregnancy) and, on the other, the availability of assistance for women deciding to carry their pregnancy to term.

Planned Parenthood Federation of America v. Bowen, 25 February 1988.

The plaintiffs were family planning (FP) services and physicians who sought a preliminary injunction against enforcement of regulations promulgated by the Secretary of Health and Human Services of the US. The regulations prohibited counseling and referral for abortion services by FP services that receive funds under Title X of the Public Health Services Act. The Court held that the regulations exceeded the Secretary's authority, since nothing in Title X or legislative history relating to its enactment indicated that Congress intended to prohibit FP services from offering information with respect to abortions. The Court also ruled that the regulations violated a woman's Fifth Amendment liberty interest in choosing to have an abortion, her First Amendment right to receive necessary information to exercise her liberty interest, and a physician's First Amendment right to disseminate necessary information to patients. The Court granted the request for a preliminary injunction. On 15 June 1988, the same court granted the plaintiffs' request for a permanent injunction against enforcement of the regulations. On 3 March 1988, the US District Court, D. Massachusetts, also enjoined enforcement of the regulations (Commonwealth of Massachusetts vs. Bowen [679 F.Supp. 137]). On 30 June 1988, however, the US District Court, S.D. New York, rejected a challenge to the regulations, ruling that the Secretary did not exceed his authority and that the regulations were not unconstitutional (State of New York vs. Bowen [690 F.Supp. 1261]).

Circular on family planning, 1988.

This Hubei, China, Circular, issued near the end of 1988, provides the following: "The population growth situation in our country is grim. Since 1986, the natural population growth rate has risen continuously. To draw the prompt attention of the whole party and the entire people to the issue of our population, all localities must seriously unfold the activities of publicizing family planning (FP) this winter and next spring, in coordination with education in current affairs. It is necessary to publicize FP in an all-around way and with accuracy, and the activities of publicizing must be carried out effectively in a solid and deep-going way. In the rural areas, stress must be placed on areas where FP work is not carried out well and where there is a prevailing tendency toward early marriage, early child-bearing, and extra-budgetary births. In cities, publicity and education must be conducted especially among the transient population, individual households, and jobless households. During the period of publicity, large-scale street-corner publicity activities must be carried out in cities and towns so as to create strong public opinion and to combine the endeavor to publicize current affairs and policies with the effort to popularize knowledge about contraception and birth-control, to execute measures of contraception and birth control, and to establish FP associations in the countryside."

Law on the Family Council, 1 June 1988.

This Law creates a Family Council, composed of 11 persons chosen by the Quebec Government for their interest in family questions. The principal function of the Council is to advise the Minister on all questions relating to family interests. In exercising this function, the Council may 1) receive all requests and suggestions on questions of family interest and make a report to the Minister; 2) submit to the Minister, in the form of an opinion, all questions of family interest that merit the attention or action of the government, and submit to the Minister its recommendations; 3) after consultation with the Minister, carry out or have carried out studies and research judged useful or necessary in exercising its functions; and 4) furnish information to the public on all questions of family interest. The Council is also to give its opinion to the Minister on any question or project of family interest submitted to it by the Minister. Further provisions of the law set forth details of personnel, meetings, and finances, among other things.

Decree No. 18238-C setting forth Regulations on the National Centre for the Development of Women and the Family, 9 May 1988.

This Decree sets forth Regulations on the Costa Rica National Center for the Development of Women and the Family. It provides that the Center is organized around a Directive Board, an Executive Directorate, and a Technical Council. The Technical Council has five areas of competence: 1) investigation; 2) dissemination and information; 3) training and organization; 4) economics; and 5) administration. Further provisions of these Regulations set forth the specific functions of the various departments of the Center.
