The AIDS epidemic at once challenges the biological, social, and political fabric of American life. Individual liberty and communal welfare are always in a state of tension in public health policy. AIDS-specific fears, merged with common distrust for scientific authority, have led to appeals to coercive state power. Others counter with equally illusory promises of voluntarism and education. In fashioning new policies we must preserve a social capacity for reasoned analysis and public discourse.
The AIDS epidemic was engrafted on a substantial and rising epidemic of sexually transmitted diseases. Complex social, political, and professional factors are examined through a single risk group to illuminate the initial and continuing failure to combat the epidemic. Selective traditional public health control measures, applied vigorously and creatively within a new legal framework, are still appropriate.
The exercise of compulsory public health powers for the common good of the community, though rooted in constitutional authority, involves a potentially massive infringement of individual liberty, autonomy, and privacy. Yet, public health statutes do not reflect modern conceptions in either science or law. Most are structurally obsolete and lack criteria for judicial oversight and impartial decision making. Guidelines for a model statute are proposed to protect both communal and personal interests.
