Legislative issues related to breast cancer.

Cancer is a political issue. Legislative decision-making as it relates to breast cancer must be driven by reliable scientific data and analysis. Carefully directed advocacy and responsible leadership can provide focus, resources, and enhancements for a beneficial impact on lives of breast cancer patients and potential patients.

Some reflections on establishing a community legislation on mycotoxins.

A Community legislation on mycotoxins is essential to protect public health and to avoid trade barriers and competition distortions. Maximum permitted levels in food are to be fixed. Some orientations for this purpose are indicated. The verification of the compliance with maximum permitted levels shall need suitable analytical methods. Up to now, such methods were fixed by directives. This approach, however, had some disadvantages. A more flexible approach is to be planned. Among the mycotoxins to be taken into consideration, priority should be granted to the aflatoxins and to ochratoxin A. Fumonisins also deserve interest. Other mycotoxins will be taken into consideration as the need arises and scientific data are available. Some basic remarks on the rationale for establishing maximum permitted levels in food are made.

Firearm violence and the effects of gun control legislation.

Two gun control laws designed to reduce different types of violent crimes were evaluated. In 1981, East St. Louis, IL, imposed stricter penalties for individuals who carry firearms outside their homes for protection (individuals could keep firearms in their homes). This law had only a temporary impact in reducing firearm use in assaults and robberies. In Evanston, IL, a slightly different approach was taken with legislation that banned handguns in the entire city (i.e., individuals could not keep handguns within their homes). A temporary reduction in firearm assaults occurred a few months before the gun law took effect. The implications of these findings are discussed.

[Adulteration of food and luxuries and the origins of uniform state food legislation in Germany].

During the last two decades, there has been an increasing movement in Germany to protect the natural environment from dangerous substances. This has renewed a growing common interest in government food control. This contribution ask the question of how this food legislation as a part of the general food and health policy in Germany came into being, and which promoting as well as inhibiting determinants in this scope could be observed. These statements are based partly on results of a project of the German National Research Council (Deutsche Forschungsgemeinschaft) in which the author investigates the change of food habits under the impact of industrialization and urbanization since the last century in a larger historical perspective and in a quantitative and qualitative manner with the help of current sources.

The effect of seat belt legislation on a district general hospital.

The introduction of legislation making the use of seat belts compulsory was associated with a marked reduction in the number of patients coming to the Accident and Emergency Department of a district general hospital as a result of road traffic accidents. Those patients who were not wearing seat belts required hospital admission twice as often as restrained car occupants. The only deaths occurring during the period of study occurred in those not using seat belts. Rear seat passengers were found to suffer from more severe and more numerous injuries than restrained car occupants. Injuries caused by seat belts were seen, usually causing bruising of the chest wall or minor fractures, and, excluding the chest, those wearing seat belt were less likely to suffer an injury to any part of the body than those not protected by a belt.

The control of organics in drinking water in Canada and the United States (standards, legislation and practice).

Both the United States and Canada have a federal form of government, but approaches used in the two countries to ensure the safety of drinking water supplies differ. The Environmental Protection Agency currently enforces regulations for 10 organic chemicals (including 6 pesticides) under the Safe Drinking Water Act and provides advice on others through its health advisory program. Canada, however, does not have similar legislation, but rather provides health-related guidelines for 21 organic chemicals (including 16 pesticides) which are used by the provincial agencies responsible for drinking water supplies. Both countries are in the process of revising their standards and will include a variety of additional synthetic organic chemicals. Where possible, standards are set using a calculated acceptable daily intake usually derived from animal feeding experiments. Procedures for setting standards for carcinogens involve a blend of risk estimation coupled with consideration of the feasibility of reducing the risk in light of socio-economic factors. Most drinking water treatment plans in North America utilize 'conventional' treatment. Some now employ modifications in order to minimize trihalomethane formation. A few use aeration or granular activated carbon to remove synthetic organic chemicals.

Community and individual considerations in legislation and test policy regarding HIV-infection in the Nordic countries--a cross national comparative study.

The purpose of the study is to facilitate international co-operation and national development on AIDS-policy by describing and comparing the programmes on the control of AIDS in the five Nordic countries. This article is focusing especially on community and individual considerations in legislation and test policy regarding HIV-infection in relation to general testing, testing of special groups, registration, voluntariness and confidentiality. The data were collected in the period of April-December 1987 by a review of existing documental material, mailed questionnaires to key persons in the health agencies in each country and personal interviews with 60 representatives of relevant organisations and institutions. The analysis of the data demonstrate that all the Nordic countries are seeking compromises which try to satisfy individual as well as community needs, although with different weight attached to the elements involved. Compared with international recommendations, national AIDS-policies in the Nordic countries in some instances do not fully respect voluntariness and confidentiality. It is concluded that AIDS-policy should be studied in the context of national traditions concerning general health policy, individual rights and community protection.

The influence of abortion legislation on maternal mortality.

Worldwide some 20 million unsafe abortions take place each year and account for approximately 13% of all maternal mortality and serious complications associated with it, such as sepsis, hemorrhage and trauma. Only a quarter of all women in the world do not have any access to legal abortion, whereas 40% have a legal right to decide for themselves. This liberalization of abortion legislation has seen a tremendous drop in abortion-related maternal mortality. Death from unsafe abortions are almost unknown in countries where abortion is available on request. Reduction of the need for induced abortion through the provision of good family planning services should be an integral part of healthcare. Consistent use of contraception greatly reduces the need for abortion, but it cannot completely eliminate this need. Thus, it is essential that safe medical abortion services should be made available to all women in the world in cases of contraceptive failure.

The transport of animals in the European Union: the legislation, its enforcement and future evolutions.

Animal transport is an important activity of the farming industry. It is also the most controversial area of animal welfare. After presenting the current legislative framework in the European Union that protect animals during transport and the main enforcement difficulties, this paper considers the international, political and scientific perspectives that lead the European Commission to draft new rules in this regard.

Overhauling oversight--European drug legislation.

At the end of next month, the European Medicines Agency (EMEA) will implement a new legislative framework and several provisions that seek to provide incentives and streamline regulatory oversight of certain monoclonal antibodies and other biologic products.

Creation of on-line solutions in support of the dissemination of legislative and analytical information on food-contact materials.

To facilitate access to European Commission (EC) documentation and provide a public service resource of relevant information an Internet site dedicated to food-contact materials was created (http://cpf.jrc.it/webpack/) in 1998. The site contains legislative information in downloadable format, information on contacts for authorities and organizations in the field of food-contact materials, as well as information on methods for overall and specific migration. A satellite site (http://cpf.jrc.it/smt/) is dedicated to physicochemical and spectral information (FT-IR, GC-MS, NMR) as well as analytical methods on an increasing number of regulated substances. Many of these, as well as substances submitted for evaluation, are held in a centralized databank at the JRC in Ispra and aliquots can be made available to the public upon request. The site also recently expanded to provide an incentive for analytical networking between institutions by including information pages on current EC-funded and national projects and conference announcements.

An industry view of compliance with European Community legislation.

This paper describes how from a situation within the European Community where each Member State had its own individual regulations for materials and articles in contact with food, the Community has developed a harmonized approach. The view is expressed that whilst this harmonization is desirable, the EC legislation as currently written is impractical. Flaws in the principles underlying EC controls are identified and whilst some parts of the harmonized regulations can form the basis for a workable scheme, substantial revision is needed. Proposals for improvement to the current Directives are suggested.

Quality and safety aspects of reusable plastic food packaging materials: a European study to underpin future legislation.

The objective of this study was to develop a comprehensive package of quality assurance criteria for use by industry and regulatory authorities for ensuring the quality and safety-in-use (sensory, microbiological and chemical) of reused plastics for food packaging. The study included thermal degradation effects, flavour carry-over caused by flavour and off-flavour substances, the influence of washing processes on the materials, and the efficiency of washing processes in removing off-flavour substances and surrogate substances representing misuse chemicals as might be put in bottles by consumers. The microbial safety of the refillable plastic articles in relation to commercial washing processes and the industrial procedures applied has also been investigated. Lastly, the suitability of laboratory procedures using strips of bottle material for predicting the sorption and washing properties of refillable plastic bottles has been studied. In general it is concluded that reuse of the articles does not significantly influence any of the properties investigated. Neither the chemical, physical nor surface properties seem to be significantly influenced by repeated washing. It can be concluded, however, that it is very likely that most of the articles investigated will cause flavour carry-over to a new filling if they are contaminated with strongly flavoured products. Finally it can be concluded that the procedures evaluated can serve as a basis for future legislation on refillable articles, but for several procedures (like quick predictive testing with strips) more investigation is required to create a more solid basis.

Functional foods: a survey of health claims, pros and cons, and current legislation.

Functional foods stand for a new category of remarkably promising foods bearing properties (i.e., low cholesterol, antioxidant, anti-aging, anticancer, etc.) that have already rendered them quite appealing. There are many classes offunctionalfoods (pro- and pre-biotics, dietary fiber, low fat, etc.), and their definition is occasionally confused with that of nutraceuticals and novel foods. Consumers' main skepticism regarding functional foods resides in the veracity of health claims and in the low and often inadequate control of their claimed properties. Legislation concerning this matter is progressing at an extremely low pace and currently only Japan, the U.K., U.S.A., and Scandinavian countries have managed to make notable progress. Moreover, the labeling of functional foods is far from informative, providing scanty information about nutritional value, storage, and cooking recipes. It is anticipated that technological advances in the food industry, in conjunction with extensive clinical trials and governmental control, will eventually guarantee the credibility of health claims and ensure consumers' confidence in functional foods.

A critical review of the quality and safety of BADGE-based epoxy coatings for cans: implications for legislation on epoxy coatings for food contact.

BADGE-based epoxy resins have been commercially available for more than 40 years. They are extremely versatile, finding applications in many fields in both thermal and ambient cure applications. The present review focuses on their use in the food industry as surface coatings for food and beverage cans, and in particular on their chemical stability in relation to their toxicology and sensorial effects on foods. The implications of these properties of epoxy resins for prospective EU legislation on plastic coatings for food contact is discussed.

Small Business Owners' Knowledge of Their Occupational Health and Safety (OHS) Legislative Responsibilities.

This article reports the results of a study investigating the nature and extent of small manufacturing business owners' knowledge of Occupational Health and Safety (OHS) issues. Interviews were conducted with 33 owners of small manufacturing businesses in Sydney, Australia. Results showed that whereas the majority of owners had basic awareness of the existence of OHS legislation, they were often unaware about the extent of their legal OHS responsibilities. Owners were found to have minimal OHS training and practical OHS expertise. Lack of appropriate industry specific OHS information was found to be a major factor that inhibited the owners' ability to deal with OHS issues effectively.

Consideration of possible legislation within existing regulatory frameworks.

Legislation on a particular food or on a particular claim to be used in connection with a food require a definition of the food and unequivocal requirements for the use of the claim. The definitions of prebiotics and probiotics presently place these terms between the categories for conventional foods and foods for special dietary uses. Because probiotics and prebiotics, as a group, do not fulfill the criteria for special dietary uses, they have to comply with the rules and laws for conventional foods even if the requirements for the use of the terms prebiotic and probiotic include effects on body functions. These effects on the health and wellness of the consumer and to stimulatory activity, eg, body defense mechanisms, can be used in claims that should underline the importance of the total dietary pattern. It is suggested that setting up rules for the use of the terms prebiotic and probiotic is preferable to creating new food standards.

AIDS-related policies, legislation and programme implementation in India.

This paper traces the evolution of AIDS-related policy and legislation in India from an initial response characterized by conservatism and discrimination to the development of a coherent national programme which aims to prevent the transmission of HIV and to develop support structures for people with HIV and AIDS. Examining the strategies, achievements and problems of specific components of the National AIDS Control Programme (NACP), the paper finds that the very progressive approach of national-level policy makers has been countered by conservative forces at the state and local levels. Little progress has been made, moreover, in incorporating HIV/AIDS prevention efforts into broader development and empowerment strategies. The paper concludes by considering the wider social context of AIDS in India and the role of more far-reaching policy measures.
