The Americans with Disabilities Act as risk regulation.

Much disability based discrimination occurs because of fears that hiring or serving people with disabilities will pose a safety risk. Disability rights laws such as the ADA strictly regulate such risk-motivated discrimination. Many disability rights advocates and academic defenders of the ADA laud such laws as applying a "scientific" approach to risk rather than the "irrational" approach generally adopted by the public at large. That position is doubly strange: It stands in remarkable tension with disability rights advocates' general suspicion of "experts," and applies a technocratic approach to risk regulation-an approach that usually has politically conservative implications-to achieve the distinctly nonconservative goal of promoting the full integration of people with disabilities into our nation's economic and civic life. In this essay, Professor Bagenstos uses the problem of risk-motivated disability discrimination as a lens through which to examine the politics of risk regulation scholarship. He argues that the easy association of technocratic approaches with political conservatism-and of democratic approaches with political liberalism or progressivism-ignores the complex ways in which technocratic and democratic institutions may serve or disserve particular political interests.

Personality characteristics of South African navy divers.

The first study aimed to determine the extent to which the 16 Personality Factor Questionnaire (16PF) can be used to describe successful divers in the South African Navy. The 16PF profiles of 100 divers were analyzed to describe the personality characteristics of naval divers. Results indicate that four personality factors were most descriptive of the sample. They were Group-orientation, Enthusiasm, Adventurousness, and Confidence. These factors seemed appropriate when discussed from an environmental demand perspective. The second study aimed to determine the extent to which the 16 PF can be used to differentiate between divers and submariners in the South African Navy. The two groups differed significantly on two factors--divers scored higher on Enthusiasm and submariners scored higher on Conservatism.

[Structural characteristics of osteopontin mRNA].

Conservatism of primary and secondary structure of osteopontin mRNA in vertebrates of various taxes was studied using computer analysis and blot-hybridization procedure. Relatively high rate of evolution of a nucleotide sequence of osteopontin gene was revealed. Formation of hairpin-loop structures by adjacent sequences and a high content of AU-pairs indicate more flexible structure of the mammalian osteopontin mRNA as compared with the avian one. It has been detected some AU-enriched regions in 3'-terminal untranslated sequences, which presence is characteristic for short-lived mRNA. Evolutionary conserved subsequences in 3'- and 5'-terminal regions were suggested to be determinants of RNA-protein interaction in cytoplasm.

On-line preparation of solutions for dialysis: practical aspects versus safety and regulations.

On-line preparation, i.e., continuous mixing and immediate use, was introduced for dialysis fluid in 1964, and it contributed significantly to the expansion of dialysis therapy through simplified handling, improved microbiology, and enhanced efficiency. On-line prepared replacement solution for hemofiltration was shown to be clinically safe as early as 1978, but the implementation was delayed for 20 yr because of regulatory conservatism. On-line preparation of sterile and pyrogen-free solutions for infusion is based on the use of water and concentrates that contribute a minimum of microorganisms and are mixed and distributed in a hygienically designed and maintained flow path. Ultrafilters with known retention capacity are placed in strategic positions and dimensioned to remove bacteria and endotoxins, which gives a sterility assurance level of at least six magnitudes, as required by the Pharmacopoeia for sterile products. Microbiologic testing of the fluid should be applied when designing, validating, and troubleshooting on-line systems but not for routine quality control, because it only gives retrospective information. Quality assurance has to be built into a system and the way it is operated. On-line fluid preparation, when properly performed, is safe, simple, and cost-effective and enhances the efficiency as well as the biocompatibility of dialysis therapy.

Integrated urban drainage, status and perspectives.

This paper summarises the status of urban storm drainage as an integrated professional discipline, including the management-policy interface, by which the goals of society are implemented. The paper assesses the development of the discipline since the INTERURBA conference in 1992 and includes aspects of the papers presented at the INTERURBA-II conference in 2001 and the discussions during the conference. Tools for integrated analysis have been developed, but there is less implementation than could be expected. That is due to lack of adequate knowledge about important mechanisms, coupled with a significant conservatism in the business. However, significant integrated analyses have been reported. Most of them deal with the sewer system and the treatment plant, while few incorporate the receiving water as anything but the object of the loads to be minimised by engineering measures up-stream. Important measures are local infiltration, source control, storage basins, local treatment and real time control. New paradigms have been introduced: risk of pollution due to system failure, technology for water reuse, sustainability, new architecture and greener up-stream solutions as opposed to down-stream concrete solutions. The challenge is to combine the inherited approaches with the new approaches by flexibility and adaptability.

[Analysis of hepatitis C virus proteins based on amino acid sequence data and literature data].

To analyze the interrelationships between the amino acid sequences of the proteins of hepatitis C virus and the functional characteristics of different variants of this virus, a database of protein functional mapping of hepatitis C virus was developed. The database contains amino acid sequences (both full-size and fragmentary) retrieved from accessible databases and experimental data published in literature. The database also contains the results of comparison and treatment of primary data, including alignments and functional regions. On the basis of these data, variable and conservative regions of envelope proteins of hepatitis C virus were revealed. Antigenic and functional maps of structural and nonstructural proteins of the virus were constructed. The most variable region of the envelope protein E2 (HVR1) was analysed. It is assumed that the conservatism of some amino acid positions of HVR1 is related to the functions of this region.

Chromosome polymorphism and C-banding variation of the brachypterous grasshopper Podisma sapporensis Shir. (Orthoptera, Acrididae) in Hokkaido, northern Japan.

The grasshopper Podisma sapporensis consists of two main chromosome races in Hokkaido. The western group of populations of P. sapporensis, belonging to the XO race, has a diploid number of chromosomes 2n = 23 in the male and 2n = 24 in the female (sex determination XO male/XX female). The eastern group of populations of this species, belonging to the XY race, differs from the western one as a result of Robertsonian translocation between the originally acrocentric X chromosome and M5 autosome in homozygous state, having resulted in the forming of chromosome sex determination neo-XY male/neo-XX female (2n = 22). These races are geographically isolated by the mountainous system consisting of the Mts Daisetsu and Hidaka range, occupying the central part of the island. The hybrid zones between the races have not so far been discovered. Various levels of polymorphism for the pericentric inversions and C-banding variation exist in different chromosomes throughout populations in both chromosome races. In some solitary populations (the population at the summit of Mt Yotei, populations in the vicinity of Naganuma, Oketo, and Tanno) pericentric inversions are fixed in some pairs of chromosomes, which enables marking of the discrete karyomorphes. In the Mt Daisengen population all chromosomes are two-armed as a result of fixing the pericentric inversions. These facts contradict karyotypical conservatism of the tribe Podismini. The level of diversity of P. sapporensis karyotypes could provide a new perspective on the evolutionary process of different karyotype in Orthoptera. The considerable occurrence of polymorphism in chromosomes suggests that karyotypic diversification is undergoing in P. sapporensis. The authors also proposed that P. sapporensis would be divided into four chromosome subraces in the XO chromosome race and two chromosome subraces in the XY race, on the basis of karyotypic features. These races may have been established by fundamental climatic changes during the glacial epoch.

Racism, ideology, and affirmative action revisited: the antecedents and consequences of "principled objections" to affirmative action.

In 2 studies, the antecedents and consequences of "principled objections" to affirmative action (specific, "race-neutral" reasons for opposing the policy) among Whites were examined. In Study 1. data from a probability sample of Los Angeles adults indicated the following: (a) that principled-objection endorsement was driven not merely by race-neutral values but also by dominance-related concerns like racism; (b) that principled objections mediated the effects of group dominance; and (c) that education strengthened-rather than attenuated-the relationship between dominance-related concerns and principled objections. whereas it left the relationship between race-neutral values and the latter essentially unchanged. In Study 2, the education findings were conceptually replicated in a panel study of undergraduates: The completion of additional years of college boosted the correlation between racism and principled objections, whereas it had no effect on the predictive power of conservatism. These results provide support for a general group-dominance approach, which suggests that factors like racism continue to shape White opposition to race-targeted policies.

A framework for prioritizing fragrance materials for aquatic risk assessment.

More than 2,100 chemically defined organic chemicals are listed in the Research Institute of Fragrance Materials/Flavor and Extract Manufacturers' Association (RIFM/FEMA) Database that are used as ingredients of fragrances for consumer products. An approach was developed for prioritizing these fragrance materials for aquatic risk assessment by first estimating the predicted environmental concentration (PEC) of these fragrance materials in the aquatic environment based upon their physicochemical properties and annual volume of use. Subsequently, an effect level was predicted with a general quantitative structure-activity relationship (QSAR) for aquatic toxicity, and a predicted no-effect concentration (PNEC) was calculated from this effect level by using an assessment factor (AF) that accounts for uncertainty in the toxicity QSAR prediction. A conservative AF of 10(6) was applied to the endpoint predicted by the QSAR to provide an adequate margin of safety in the calculation of the PNEC. The PEC was compared to the PNEC to characterize the risk to freshwater aquatic organisms (e.g., Daphnia magna and Pimephales promelas). If the ratio of PEC to PNEC was below one, the material was considered to have negligible environmental risk and to be acceptable for the aquatic environment at current use levels. If this ratio exceeded one, the PNEC was refined by using more specific QSAR models (Ecological Structure-Activity Relationships [ECOSAR]). If the ratio continued to exceed one, the material became a candidate for further aquatic risk assessment procedures, which involve iterative steps to refine the PEC, the PNEC, or both by using measured ecotoxicological endpoints. Prioritization for this latter process can be based upon the magnitudes of the estimated PEC:PNEC ratios. When using the first tier of this approach, only 568 of 2,141 fragrance materials (26.5%) in the RIFM/FEMA Database had PEC:PNEC ratios greater than one. This percentage decreased to only 164 materials (7.7%) when PNECs were derived with ECOSAR. Comparison of predicted PECs and PNECs with those based upon measured data confirmed the conservatism and low risk for type I errors associated with the framework. These combined exercises demonstrated the ability of this highly precautionary risk-based screening approach to quickly prioritize a large number of materials without benefit of experimental ecotoxicological or fate data.

Phylogenetic relationships of fig wasps pollinating functionally dioecious Ficus based on mitochondrial DNA sequences and morphology.

The obligate mutualism between pollinating fig wasps in the family Agaonidae (Hymenoptera: Chalcidoidea) and Ficus species (Moraceae) is often regarded as an example of co-evolution but little is known about the history of the interaction, and understanding the origin of functionally dioecious fig pollination has been especially difficult. The phylogenetic relationships of fig wasps pollinating functionally dioecious Ficus were inferred from mitochondrial cytochrome oxidase gene sequences (mtDNA) and morphology. Separate and combined analyses indicated that the pollinators of functionally dioecious figs are not monophyletic. However, pollinator relationships were generally congruent with host phylogeny and support a revised classification of Ficus. Ancestral changes in pollinator ovipositor length also correlated with changes in fig breeding systems. In particular, the relative elongation of the ovipositor was associated with the repeated loss of functionally dioecious pollination. The concerted evolution of interacting morphologies may bias estimates of phylogeny based on female head characters, but homoplasy is not so strong in other morphological traits. The lesser phylogenetic utility of morphology than of mtDNA is not due to rampant convergence in morphology but rather to the greater number of potentially informative characters in DNA sequence data; patterns of nucleotide substitution also limit the utility of mtDNA findings. Nonetheless, inferring the ancestral associations of fig pollinators from the best-supported phylogeny provided strong evidence of host conservatism in this highly specialized mutualism.

[Neuroscience in ancient Egypt and in the school of Alexandria].

INTRODUCTION: About five thousand years ago, one of the most ancient, important and enduring civilisations in the history of Mankind flourished on the banks of the Nile. In Egypt, all the branches of human knowledge attained a high degree of development and today it is considered the mother of medicine. Despite the marked religious component that affected all its activities, the medicine of the Pharaohs was practised in a rational and deductive manner, and the Egyptians were the inventors of clinical observation. METHOD: The desert climate of the Nile Valley has preserved monuments, mummies and papyruses which have enabled us to get a certain idea of the degree of development reached in medical matters. The aim of this work is to analyse them from a neuroscientific point of view. The anatomical discoveries of the Egyptians originated in the inspection of wounds and the practice of embalming. They came to know a large number of diagnoses and were able to prescribe many different forms of treatment. They also attained a certain proficiency in dealing with neurotraumatological patients. They practised anamnesis, prognostics and a regulated surgery that infrequently included trephination. Their conservatism meant that, after the Macedonian domination, the traditional Egyptian medicine was replaced the Greek medicinal arts, which reached their maximum period of splendour in the School of Alexandria, where Herophilus and Erasistratus, pioneers in the study of anatomy and brain circulation, were especially renowned. CONCLUSIONS: From the point of view of the neurosciences, the Egyptians were the first to describe the brain, migraine, epilepsy, strokes, tetanus, Bell s palsy and the sequelae of head injuries and of spinal transection. Their artwork sometimes shows neurological patients and, according to Herodotus, there were doctors who were specialised in head diseases and could therefore be considered the precursors of our present day neurologists.

Comparison of pesticide root zone model 3.12: leaching predictions with field data.

As part of a process to improve confidence in the results of regulatory modeling, predictions of the pesticide root zone model (PRZM) 3.12 were compared with measured data collected in nine different field leaching studies. Reasonable estimates of leaching were obtained with PRZM 3.12 in homogeneous soils where preferential flow is not significant. The PRZM 3.12 usually did a good job of predicting movement of bromide in soil (soil and soil pore-water concentrations were generally within a factor of two of predicted values). For simulations based on the best choices for input parameters, predictions of soil pore-water concentrations for pesticides were usually within a factor of three and soil pore-water estimates within a factor of 11. When the model input parameters were calibrated to improve the simulation of hydrology, predicted pesticide concentrations in soil pore water were usually within a factor of two of measured concentrations. Because of the sensitivity of leaching to degradation rate, the most accurate predictions were obtained with pesticides with relatively slow degradation rates. When conservative assumptions were used to define input pesticide parameters, predictions of pesticide concentrations were usually a factor of two greater than when using the best estimate of input parameters without any built-in conservatism.

The U.S. Navy decompression computer.

The U.S. Navy has recently approved the Cochran NAVY decompression computer (DC) for use in Naval Special Warfare diving. This action represents the first approval of a diver-worn DC for use in the U.S. Navy. This paper reviews the development and testing of both the decompression algorithm and the hardware chosen for the Navy's DC. The decompression software in the Cochran NAVY is the VVAL 18 algorithm developed at the Navy Experimental Diving Unit (NEDU) by Captain Ed Thalmann. A discussion of the relative conservatism of the VVAL18 algorithm in comparison to the U.S. Navy Standard Air Tables and the basis for the differences between the two is provided. The initial guidelines establishing DC diving practice for the Navy SEAL community are outlined as are plans for future research efforts in U.S. Navy DC diving.

Kanyakumari district accepts family planning.

The people of Kanyakumari District known for their die-hard conservatism, finally seem to have taken to family planning as a way of life. This is borne out by the overwhelming support extended by them to the tubectomy camp organized by the District Family Planning Bureau, Kanyakumari, from 22nd to 27th February 1972. The target of 300 operations set for the camp was exceeded by 99. This is a significant achievement considering the fact that the district consists of only 9 Panchayat Unions covering a vast coastal area with a population of over 1/2 lakhs which is mainly engaged in the fishing industry and is generally not in favor of family planning. The camp provided free food and transport facilities to the patient and the person attending her and a monetary incentive of Rs. 30 per case, besides post-operational care which included periodical home visits by the staff of the Public Health Center for over 3 months. Administration of Vitamin A solution and immunisation of the children of the acceptors and their neighbors constituted an additional feature of this campaign. The effort made by the staff of the Family Planning Department, the Maternity Assistants of the Headquarters Hospital, Nagercoil, where the camp was held, and the Field Publicity Department of the Government of India, were responsible for the success of this campaign.

[Purine regulon of gamma-proteobacteria: a detailed description].

The structure of the purine regulon was studied by a comparative genomic approach in seven genomes of gamma-proteobacteria: Escherichia coli, Salmonella typhi, Yersinia pestis, Haemophilus influenzae, Pasteurella multocida, Actinobacillus actinomycetemcomitans, and Vibrio cholerae. The palindromic binding site of the purine repressor (consensus ACGCAAACGTTTGCGT) is fairly well retained of genes encoding enzymes that participate in the synthesis of inosinemonophosphate from phosphoribozylpyrophosphate and in transfer of unicarbon groups, and also upstream of some transport protein genes. These genes may be regarded as the main part of the purine regulon. In terms of physiology, the regulation of the purC and gcvTHP/folD genes seems to be especially important, because the PurR site was found upstream of nonorthologous but functionally replaceable genes. However, the PurR site is poorly retained in front of orthologs of some genes belonging to the E. coli purine regulon, such as genes involved in general nitrogen metabolism, biosynthesis of pyrimidines, and synthesis of AMP and GMP from IMP, and also upstream of the purine repressor gene. It is predicted that purine regulons of the examined bacteria include the following genes: upp participating in synthesis of pyrimidines; uraA encoding an uracil transporter gene; serA involved in serine biosynthesis; folD responsible for the conversion of N5,N10-methenyl tetrahydrofolate into N10-formyltetrahydrofolate; rpiA involved in ribose metabolism; and protein genes with an unknown function (yhhQ and ydiK). The PurR site was shown to have different structure in different genomes. Thus, the tendency for a decline of the conservatism of site positions 2 and 15 was observed in genomes of bacteria belonging to the Pasteurellaceae and Vibrionaceae groups.

[Karyotype of chironomid Xenochironomus xenolabis (diptera, chironomidae)--obligatory miner of fresh water sponges].

The karyotype of chironomid Xenochironomus xenolabis has been first described. Chromosomes of X. xenolabis have a peculiar spatial organization: subcentromere areas of all chromosomes join together in one common chromocenter. Seven chromosome arms (A = B = C > D > E > F > G) are conventionally recognized in the karyotype. Each arm is subdivided into sections, beginning with the centromere area. The nucleoli are located in arm B and probably D. No chromosome reorganization was found in X. xenolabis. The strong conservatism and ordered organization of the chromosome set in X. xenolabis seem to be determined by a specific life style of its larvae and, consequently, by a relatively constant habitation conditions.

A discussion of the U.S. EPA methodology for determining Water Quality Standards (WQS).

Based on material published by the U.S. Environmental Protection Agency (U.S. EPA) in the Federal Register for 19 November 1991, many state environmental agencies have proposed and/or adopted revisions to their State Water Quality Standards (WQS) for organic and inorganic chemicals in fresh and marine waters (see, for example, State of Connecticut, Department of Environmental Protection, Bureau of Water Management, (1992), memorandum to Interested Parties concerning the Water Quality Standards Hearing Report). Generally, many states simply republish the U.S. EPA's proposed Water Quality Criteria (WQC) as the State's proposed WQS. Many of the state WQS and federal WQC values--especially those for organic compounds regulated as human or animal carcinogens--are much more stringent than the values now in effect because the U.S. EPA's new methodology (i) for estimating exposure point concentrations, exposure doses, carcinogenic potency, and incremental lifetime cancer risk and (ii) for setting the target acceptable risk combine a series of conservative assumptions into an equally conservative set of results. In the Federal Register proposal, the U.S. EPA failed to honor its standard risk assessment methodology in that (i) it failed to perform a quantitative or even qualitative uncertainty analysis and (ii) it failed to analyze the overall degree of conservatism in the results. The U.S. EPA suggested that the analysis is suitably conservative for the average exposed adult, but it failed to consider various phenomena that make the proposed WQC far more conservative than acknowledged or intended. To focus on a central problem of manageable size, this article dissects the method by which the U.S. EPA calculates proposed WQC for organic chemicals regulated as human or animal carcinogens. Because the results for most such chemicals are driven by the pathway for the human ingestion of fish which have bioconcentrated the chemicals from the water column (as opposed to the pathway for direct ingestion of water by humans), this article focuses exclusively on the fish-to-human pathway. These considerations form the basis of general quality assurance criteria and standards.

Modern treatment of abruptio placentae.

Abruptio placentae, in its severe form, causes the most hazardous type of third trimester bleeding. The severe grade may be accompanied by systemic effects, some of which are potentially lethal. A knowledge of these, as well as a system of grading the severity in terms of maternal risk, is essential to an understanding of therapy. Cases should be graded in severity from I to III on the basis of clinical factors. A delay in delivery, in Grade III, may result in an increased incidence of serious maternal complications. In Grade II, immediate cesarean section has reduced the fetal mortality rate. IN MANAGING GRADE III PREMATURE SEPARATION OF THE PLACENTA, THE FOLLOWING STEPS SHOULD BE CARRIED OUT: (1) Laboratory study, including blood cross-matching and determination of plasma fibrinogen; (2) vaginal examination to confirm the diagnosis and to rupture of the membranes; (3) indicated therapy of systemic effects with fresh whole blood and fibrinogen, before considering any operative delivery; (4) election of a mode of delivery which will terminate the pregnancy in less than about six hours after onset of separation; this will frequently be cesarean section; (5) careful attention to postpartum care to avoid shock and renal failure. In Grade II, the same principles of therapy obtain. If the fetal heart tones are present, however, and vaginal delivery is not imminent, immediate cesarean section is justified. Complete conservatism, with vaginal delivery, is recommended in Grade I.
