Informed consent: information about the physician.

Does the doctrine of 'informed consent' require disclosure about the physician? Recent developments indicate that the doctrine requires information not only about the treatment but also about the physician. There is also modification in the requirement of proof of a causal nexus between the lack of informed consent and injury.

Legal aspects of post-traumatic stress disorder.

The legal requirements for compensable injury in civil law gradually has loosened over the years from the physical effects of direct injury to include the emotional effects of direct injury, the emotional effects of witnessing injury to others, the emotional effects of knowing of injury to others, and a person's fear that he or she may become ill at a later date. Although a psychiatric diagnosis is not required to bring action, post-traumatic stress disorder (PTSD) has become the favored diagnosis in cases of emotional distress. Also, in criminal law, defenses based on PTSD have become increasingly common, being used as the standard defense in selected situations. The limits of the use of PTSD as a defense remain to be clarified; differing judgments have been made in similar cases by different courts.

The multiple personality and the criminal law.

Multiple personality disorder (MPD) is a growing phenomenon in the United States. The number of cases have mounted following the celebrated cases of 'Three Faces of Eve' and 'Sybil' that have been popularized over the past several decades. How can--or should--the criminal law deal with multiple personality? Should the defendant suffering MPD be deemed competent to stand trial, or be able successfully to assert the insanity defence, or diminished capacity or automatism? Does MPD qualify as a mental disease or defect under the test of criminal responsibility, which would call for commitment upon a finding of not guilty by reason of insanity? What is the effect of MPD on cognition or control? These issues are discussed.
