NSAID gastropathy, misoprostol, and the standard of care.

This medicolegal presentation is designed to introduce the legal notion of the standard of care as it pertains to potential legal exposure. The medical topics of nonsteroidal antiinflammatory drug (NSAID) therapy, NSAID gastropathy, and misoprostol are discussed in relation to the standard of care. The legal theories of informed consent and informed refusal are presented as they apply to this issue. A few simple commonsense points are offered for practice integration.

Informed consent and the gastrointestinal endoscopist.

The gastrointestinal endoscopist should be familiar with the Doctrine of Informed Consent. Although the concept is difficult to apply clinically, a reasonable approach is presented to the endoscopist. The ultimate goals of informed consent are shared decision making and self-determination, but it is important that the endoscopist also consider the potential legal liability when obtaining informed consent.

Must we pay for medical education?

This month, I present a situation in which gastroenterologists have been incorporated into a money-raising plan to support a university hospital's medical education program. This issue of whether such a plan could be enacted is addressed. Provided the bylaws contain no prohibitions and the plan itself is not unreasonable or unfair, it appears that successful enactment is likely. The issue of equal protection is presented as it applies to the enactment of this plan to gastroenterologists. Finally, a few of the down side effects of the plan are presented. It would be safe to say that as the economics of health care delivery continue to evolve, situations like the one presented herein will arise.

The letter of recommendation.

This month I discuss the dilemma of the department chief who has been asked to write a letter of recommendation for a trainee who has a few deficient areas of endoscopic ability. I emphasize the basic duty of the author to be honest as I describe the contents of the letter. Finally, I discuss the issue of potential legal liability for the author of either a favorable or unfavorable letter.

The feeding dilemma: In the Matter of Conroy.

This month's column addresses the issue of whether life-sustaining treatment in the form of nutrition may be refused or terminated by a patient. The New Jersey Supreme Court's recent decision of In the Matter of Conroy is discussed and reviewed.
