Trauma care systems.

Injury is a major cause of disability and death in the United States. The effective development and implementation of trauma care systems has the potential to reduce substantially the level of morbidity and mortality otherwise suffered by trauma and injury victims. However, extant trauma care systems have been strongly affected by disruptive forces, particularly uncompensated care of the indigent. The passage of proposed federal legislation (S 15 and HR 1602) may serve to relieve some of the more financially stressed trauma centers and construct a framework for trauma care systems having a viable future. A possible long-term solution to the severe financial problems posed by indigent care could involve federally funded health insurance.

HIV testing: the legal balance between individual and societal rights.

Testing for the presence of human immunodeficiency virus (HIV) antibodies creates a legal conflict between the individual's right to autonomy and privacy versus society's right to control the public health. A body of laws exists to address these conflicting rights. These laws, however, must evolve so as to strike a better balance between what society has a right to know and the individual's right to personal autonomy and privacy. Appropriate statutes should recognize that a legitimate need may arise for a physician to disclose otherwise confidential testing data to the spouse and other intimate sexual partners of an HIV-infected patient.

Physician ownership-referral arrangements in the United States.

Physician ownership-investment arrangements are increasingly being subjected to public and professional scrutiny. One view is that some of these arrangements may have distinct beneficial, legitimate effects, possibly including increased availability of health care services and state-of-the-art technology. A contrasting view is that such practices are unethical and may result in excessive utilization of services and concommitant increases in medical costs. Legislation has been proposed in the United States Congress which may severely curtail or prohibit various physician ownership-investment relationships. A serious need exists for the collecting of further quantitative data on this subject.

Hawaii and the AIDS epidemic.

Hawaii has enacted legislation pertaining to the AIDS epidemic. This legislation pertains to such areas as HIV testing, informed consent for testing, confidentiality of HIV-related data, quality assurance standards for HIV testing, and requirements pertaining to insurance availability. Physicians in the State should be aware of these legal requirements, particularly as they may affect medical practice in the state.

Patient dumping.

Transfer of patients from one hospital to another for economic reasons or so-called "patient dumping" is discussed. An estimated 250,000 persons per year may be affected. Patient dumping may be associated with increased morbidity as well as mortality. Federal legislation, including the Hill-Burton Act and an amendment to the Consolidated Omnibus Budget Reconciliation Act of 1985, has been enacted pertaining to emergency care for the poor. The efficacy of these laws, however, has been debated. Tough questions remain regarding viable ways to finance health care for the poor.
